Terms and Conditions of Sale
1. The highest bidder to be the Purchaser. If any dispute arises, the Auctioneers shall have absolute discretion to settle it and put up any disputed Lot again.
2. Such advances to be made as shall be determined upon at the time of sale. The Auctioneers reserve the right to refuse any bidding.
3. All lots are put up for sale subject (a) to any reserve price imposed by the seller and (b) the Auctioneers and Vendors reserve the right to make biddings for each Lot and to alter the Lotting as may be considered necessary, and to withdraw any Lot or Lots from the Sale.
4. The full purchase money for each Lot is to be paid at the fall of the hammer, the declaration of the name of the purchaser shall be deemed a full and sufficient acceptance of the Lot, which shall be and remain in every respect at the absolute risk of the respective purchaser or purchasers thereof, and shall be removed from the place of sale at the purchaser’s expense, and taken with all faults and errors of description, the Auctioneers not holding themselves responsible for the correctness of the description, the genuineness or authenticity of, or any fault or defect in any Lot. The Contract of Sale is to be deemed in all cases as made exclusively with the Auctioneers, and the payment is to be made to them alone.
5. NO LOT OR LOTS SHALL BE REMOVED FROM THE PREMISES ON WHICH THE SALE IS HELD UNTIL PAID
FOR, nor shall any person be allowed to retract his or her bidding, but give his or her name and residence on demand.
NO LOT UNDER ANY CIRCUMSTANCES TO BE REMOVED DURING THE HOURS OF SALE but all Lots must be taken delivery of within two days of the sale. No relaxation whatever can be made to this condition. Should any damage be occasioned by any purchaser(s) to any property of the Vendor which is either reserved of unsold, the purchaser shall make good the same or pay a sum in damages which may be agreed between the Auctioneers, as representing the seller, and such purchase, or failing agreement as to said damages, the amount shall be settled by the Auctioneers whose decision shall be final.
6. Buyers paying by cheque or means other than cash such as a bank transfer must make prior arrangements with the Auctioneers. Cheques should be made out to Lindsay Burns & Company. The auctioneers accept payment by Debit cards issued by United Kingdom banks, there is no additional charge for purchases made with these cards. Debit cards issued by overseas banks, deferred debit cards and all credit cards will be subject to a 3.5% surcharge. Visa and
MasterCard Credit cards are accepted; please note that there is a 3.5% surcharge on the total invoice value when payment is made in manner.
7. The purchasers will be held responsible to the Vendors for any unnecessary or wilful damage that may be done by their servants or workmen in the removal of Lots sold, whether to the structure of the house, buildings, fixtures, gates, gate posts, roads, fences or any part or parts of the property or contents.
8. It is hereby expressly stipulated that all sales be cash transactions at the fall of the hammer, notwithstanding a bill statement may be delivered to the purchaser at the end of the sale, for the convenience of such purchaser, no stamped receipt shall be required by such a purchaser, except at his or her own expense.
9. If any purchaser shall fail to comply with the above conditions or any of them, the Auctioneers shall be at liberty to recover in full the amount of purchaser money of the Lot or Lots bought by such purchaser, together with 5 per cent interest, and all costs, charges and expenses, without reference to any delivery or acceptance of the Lot or Lots other than the first delivery by the fall of the hammer, and the declaration of acceptance as before stipulated; or to re-sell any Lot or Lots bought by such purchaser, either by public or private sale, and the full amount of the purchase money at the present sale, or the deficiency (if any) arising from the second sale together with all interest, cost, charges and expenses, shall be made good by the defaulter, at the present sale, and be recoverable as and for liquidated damages.
10. Neither the Vendor nor the Auctioneers shall be responsible for any loss, damages or injury occasioned to or sustained by any person on the premises, before, during or after the sale howsoever the sale may arise.
11. All Lots marked with the prefix * indicates VAT is payable in addition to the Selling Price.
12. All Lots prefixed with @ indicates that VAT is included in the Selling Price.
13. All Lots prefixed with AR indicate that they are subject to Artists Resale Right. This will only apply to items selling over 1000 Euros. See saleroom notices for full details.
14. Buyers premium is charged at 15% plus VAT on the hammer price of all lots sold.
15. Lindsay Burns & Company offers an online bidding service via the-saleroom.com. This service is provided for bidders who cannot attend the sale. Online auctions allow you to watch and listen to the sale in real time. To view the catalogue and register for the sale please go to
